And the plaintiffs want restitution, of course.<\/p>\n<p>Apple admits it made recordings of people talking to the Siri voice-control system to improve the system. As part of the process, some of these were listened to by humans.<\/p>\n<p><!--more--><\/p>\n<p>A whistleblower claims third-party contractors working for Apple <a href=\"https:\/\/www.cultofmac.com\/641554\/siri-accidentally-overhears-apple\/\" data-lasso-id=\"227402\">frequently overheard private conversations<\/a> that were recorded when an iPhone or Apple Watch mistakenly believed that the user had activated Siri. This caused the company to suspend its practice of having people review recordings.<\/p>\n<p>\u201cWe are committed to delivering a great Siri experience while protecting user privacy,\u201d Apple said in a statement. \u201cWhile we conduct a thorough review, we are suspending Siri grading globally. Additionally, as part of a future software update, users will have the ability to choose to participate in grading.\u201d<\/p>\n<h3>Lawsuit demands permanent changes<\/h3>\n<p>A <a href=\"https:\/\/www.courtlistener.com\/recap\/gov.uscourts.cand.345934\/gov.uscourts.cand.345934.1.0.pdf\" data-lasso-id=\"227403\">suit filed<\/a> in the Nothern District of California accuses Apple of \u201cunlawful and intentional recording of individuals\u2019 confidential communications without their consent from approximately October 2011 to the present.\u201c<\/p>\n<p>As evidence, they point out that Apple\u2019s privacy policy says \u201cWe may collect and store details of how you use our services, including search queries. This information may be used to improve the relevancy of results provided by our services.\u201d The plaintiffs do not believe that this covers the company recording accidental Siri interactions and letting third-party contractors listen to them, especially when the people being recorded are children.<\/p>\n<p>They want Apple to get consent before recording any minor\u2019s Siri interactions, and all previous ones deleted. As mentioned, the company has already promised to allow people to opt out of its Siri review program. And anyone can <a href=\"https:\/\/www.cultofmac.com\/642316\/how-to-stop-siri-logging-and-sharing-recordings\/\" data-lasso-id=\"227404\">make their iPhone stop making these recordings<\/a>.<\/p>\n<p>The plaintiffs in the proposed class action lawsuit also want \u201crestitution of Plaintiffs\u2019 and the Class members\u2019 money and property lost as a result of Apple\u2019s acts of unfair competition.\u201c This comes from their claim that they bought Apple devices because these would better protect their privacy than rivals\u2019 would, something they say these secret recordings indicate isn\u2019t true.<\/p>\n<p>If Apple doesn\u2019t rectify their complaints within 30 days, the plaintiffs warn that they\u2019ll seek punitive damages.<\/p>\n<h3>Not yet a class action<\/h3>\n<p>A lawsuit like this one isn&#8217;t actually a class action yet. The plaintiff, Fumiko Lopez and a minor, have asked that it be certified one, but it&#8217;s up to the court.
